Recently was given a ticket for speeding because I did not wait until I passed the speed limit sign to accelerate to the increased speed. I could not have been 40 feet from the sign. If I lived in this town, I would move simply because I would be embarrassed for anyone to know I lived in a place where this type of attitude exists. I had just commented to my passenger that I could count on one hand how many times I had not seen a police officer running radar in the 25+ years I have driven this highway through this town. I have several friends that are officers and NONE of them said they would have even considered stopping someone for this much less given them a ticket. I guess Barney Fife is alive and well in Eustace.

Eustace, Texas on US 175 East and West Bound

The speed limit on US Highway 175 East and West bound varies (70 MPH down to 30-35 MPH) as you travel along rural areas and then rather suddenly into small towns, usually without much, if any warning. Some of the areas along the highway, before entering a town, having warning signs, i.e. there is a speed limit sign ahead forewarning you that the speed limit is about to change and what that speed limit will be (so you have two chances to reduce your speed). Without driving the 70 or so miles back from Dallas to Eustace, I do not recall ever seeing any such warning sign (they may be there and I was daydreaming?) nor the fact the speed limit changed from 70 to 55. I was ticketed for doing 67 in a 55 MPH zone as I came around a curve into Eustace…heading north West on US 175 towards Kaufman and Dallas. Eustace ticket prices are out of site…$185 for 11-15 miles over the speed limit in my case. In reviewing the latest annual Eustace city budget (October 2011 to September 2012), it is very obvious that the city derives the majority of its city budget from fines ($210,500). That same total budget for the city shows $448,682.32 of expenses of which $224,054 is for various police expenses (50%). So it is pretty obvious that they are a speed trap. The Eustace Police department only costs the city about $13,554 ($224,054-$210,500) a year. The difference is made up in property and sales taxes. If someone else has a better evaluation, let me hear from you.

The entire stretch of Hwy 175 is the cities source of income. I asked for a jury trial, and had a hung jury until the judge at the direction of the prosecutor told the jury they had to stay until they reached a verdict which is legal but the judge was so in awe of tjw prosecutor that she looked to her for every piece of evidence I tried to enter and every objection I made. After the construction was finished there the speed limit was different going north than it was entering town from the south. It was explained to me in court that the speed limits were posted correctly and I could never get Txdot. to give me a straight answer about what the correct speed limit was, but suddenly tjw signs have been changed to reflect what the limit should have been all along. I’m now looking to have the court dismiss the ticket and refund the fines, and if they don’t I’m going to explore a class action suit to refund fines for the past five years because I believe the local police knew they were writing tickets that shouldn’t have been given and if not they should have. If you got a ticker traveling north out of town you should contact the court as well.

High enforcement area on U.S. 175 in and around Eustace. The entire area in question covers Henderson County Precinct 3, from about halfway between Athens and Eustace to the Kaufman County Line (you can tell when you enter Precinct 3 because the county road numbers go from the 2000s to the 3000s). The Eustace PD, along with a State Trooper who patrols the area, are out looking for suckers constantly. The trooper in particular isn’t afraid to falsify your alleged speed to write you up. Don’t even think about going 1 mph over the limit through here.

The Texas Department of Public transportation has a two year highway construction project in progress on US-175. The small town of Eustace is funding itself by hiring extra officers to write speeding tickets, some as low as one mph over the limit. Even the local Texas State Troopers think the Eustace speed trap is feather-legged and do not enforce the speed law until violations of at least 10 mph over the limit.
