This is an illegal speed trap. Newburgh Heights sits on the Cleveland side of the highway near the Fleet Ave. exit (none of that is their property) and clocks people with their photo-radar gun, which automatically issues fake tickets (“civil citations”), but the illegal part is that they do not have signs up warning drivers about this speed trap.

Check out ORC 4511.094 (A) (1) – which states that municipalities must post signs about any photo-traffic enforcement in their jurisdiction. Newburgh is running an illegal cash grab in their little village with only 2,000 residents. They don’t even have a municipal court. The police dept. has told me that their citations are legal because the law applies only to fixed cameras. Nope, sorry, the law does not specify what type of cameras – so that means ALL cameras must have a sign. Sorry Newburgh Heights, you’re issuing illegal tickets and it’s just a matter of time before you use some of those millions you’ve collected against the law and put up a damn sign. Or stop issuing fake, illegal tickets all together. Pull the cars over or follow the law. What a disgrace.

I take it that there is a patrol office standing somewhere with a camera. Where I couldn’t tell you, but when you come off the Harvard ramp and make a left hand turn as I did your picture is taken. On the right hand side when you come off the freeway there is a BP station. So the police officer is somewhere there.

The stretch of Harvard between the Denison Harvard Bridge and I-77 is 25 MPG and there are speed cameras in operation. $150 ticket for going 35 in this zone where 25 MPG is totally unnecessary. Clearly a money-making venture for a small town.

Cameras have been set up on Harvard Ave near E 52nd beginning the week of September 13th, 2013. Anyone traveling above the 25mph speed limit in that stretch of neighborhood gets hit with a $100 civil fine.

I believe this area is technically Cleveland, but I often see a Newburgh Heights cruiser sitting in the grassy hill just past the Fleet Avenue underpass.You can’t see it until you pass under the overpass, which it is then too late. Don’t go over 60 MPH On 77 on this stretch.
