Main St Eastbound and 2nd Avenue

As you leave downtown Lyons on Main Street going east, you round a 45 degree bend at about 3rd Street and head out of town. Ahead you will see a 40 mph speed limit sign, so you speed up. A Boulder Sheriff hangs out behind a bunch of construction signs on the right side of the road and nabs motorists who see the 40 mph sign and speed up. He tags people about 50 feet before they pass the sign.

Yep an officer stopped me and ticketed me today. Said he reduced my official speed to help me out. Nice guy very professional. What are the official rules regarding changing from one speed to the other in the handbook? When you see a new speed limit and accelerate to meet it. Are you speeding before the sign? He said that "you cant speed up until after the sign." My friend helped me dig up the Colorado Drivers handbook. Here is what it says on page 21 under Limits. I quote, "Speed limit signs indicate the maximum speed allowed in ideal conditions. Some roads, such as freeways, have minimum speed limits posted. Driving slower than the minimum speed limit, in ideal conditions, is a traffic violation." What if there is not a posted Minimum speed? There is also such a thing as impeding the flow of traffic. By my understanding this means if you are going slower than the posted 40 mph speed limit after you pass that sign your are in violation of the law. Does this mean that The town of Lyons and this officer are abusing this fact? As a citizen with a new $120 Ticket because I was approaching the 40mph speed limit. I would like to think that is a no. I was not able to verify what the officer said as the Handbook does not say when you are to speed up. Frustrated citizen.

The entire section of Highway 36 north of Lyons is one big speed trap! Miles of it are posted as a construction zone with double fines even though work is concentrated only in certain areas along that stretch. What a scam!!! Coloradans are being victimized twice, first by the flood now by the state. 25 mph is a burden to those who pass through there and discourages travel to Estes Park.
