Panorama Dr is considered by law enforcement to be a local or residential street, but after pulling street descriptions from the Benicia Planning Department, I found Panorama to be classified as a minor arterial, therefore exempting it from the California default speed of 25 MPH. I pulled the recent radar speed survey for the city of Benicia and Panorama Drive is not on the list within the last five years. The study has not been done, and therefore law enforcement has no legal right to enforce a limit that is not in compliance with the MUTCD (Manual on Uniform Traffic Control Devices). The speed limit here is posted at 25 MPH and often the signs are obscured by trees or shrubs.
If you get a ticket here, you should be able to win in court if you have the chance to fight it. I spent over an hour on the stand yesterday at the Solano County Courthouse in Vallejo arguing these points to a Pro Tem Judge, who I don’t think understood the laws here. I have him case laws to look over from several sister states and he did not find me guilty. I am awaiting verdict by mail after he goes over the 60 pages of case laws I dropped on him at trial!
