Sims Road near La Madrona Drive

Santa Cruz, CaliforniaJun 15, 20071 Comments

Motorcycle cops sit in my driveway on Sims Road and radar cars coming from Graham Hill Road. We’ve seen as many as 15 arrests in an hour. You wouldn’t expect it but the speed limit is 25, and they enforce it.

Comments:
I got a radar ticket here 18 mos. ago......I went to court & beat it.....The road is not zoned for radar ussage....There are certain conditions which police can use radar w/o the road being surveyed...This road does not meet the criteria for radar ussage w/o having a survey...State law mandates that the road must be less than 1/2 mile long, one lane each way, and less than 40 feet wide for radar ussage and a survey NOT necessary....ALL above must apply for the road to be excempt from a survey.......Simms road is more than 1/2 mile long.....I mesured the road with a walking tape measure for proof.....It is also noted in the County Department of Public Works - Maintained Road Data.....This Department lists the road distance at .59 miles....This can be confirmed in Calif. Veh. Code Section-40802...I was convicted at trial but was overturned by the appeals court....Took over 1yr. start to finish but my DMV record is clear & no affect on ins.....Good Luck.....You should be able to beat this one...
