State Route 35 near City Limit Signs

Winfield, West VirginiaApr 19, 20071 Comments

At start of town and end of town speed limit drops from 55 to 40. They sit right at sign and even if 1-2 MPH over limit will ticket you. Cost of ticket is between $100-$150.

Comments:
I was ticketed for one mile over the speed limit and the fine is $165.00. -- Two days ago I was pulled over on this route having passed a vehicle legally in a legally passable area with no oncoming traffic in clear and dry weather conditions. I was pulled over because the officer said that the vehicle I was passing was "nearly" doing speed limit and there was no reason I should have passed. (The vehicle i was passing was slower than speed limit --- not "nearly" at speed limit.) The officer continued to explain many accidents have happened on that road. He ticketed me for 1 mile over speed limit. He said there will be no points on my license. When I asked him If he knew for a fact that I was speeding he shrugged his shoulders. Just because many accidents have happened on that road does not mean I was unsafe or doing something illegal. He was subjective in his language and judgement and in my opinion, outside of the law. I live suburb Chicago, IL area and fighting this ticket would be futile. Law enforcement can be unlawful and criminal in itself. Writing me up for one mile over and charging me $165.00 dollars is unjust. Shame on this county and this state trooper. Where is their conscience?
