Telegraph Rd and Orchard Lake Rd

Watch out for ‘THE’ Sylvan Lk cop he is on a mission to single handedly fund the USDOT and make every truck (including pick up trucks) members and financiers of the DOT.

Comments:
There were two police vehicles sitting in the open, one on each of the grassy slopes next to the on and off ramps to Old Orchard Lake Road. The first car sits right before the speed limit sign where the speed increases from 40 to 45 mph and measures people with radar. The other sits on the other side of Old Orchard Lake Road waiting to pull people over after being clocked. This is most definitely a speed trap. The speed increases from 40 to 50 mph in only 0.5 miles and most drives appear to go between 50 and 55 all along this stretch (that seems to be the natural flow of traffic). I am currently requesting the PA 85 Engineering Survey for this area. I have been told unofficially that a survey has been completed and speeds should actually be posted as 50 or 55 but that just hasn't been made official. If no survey exists, the speed limit should be 55 mph by default. Either way, the posted speeds are artificially low. MORE IMPORTANTLY, these officers are Sylvan Lake officers who are actually sitting outside of Sylvan Lake boundaries (that intersection is located in the City of Pontiac, check a map) and that stretch of Telegraph Road is also in Pontiac. As a result, the infractions they are witnessing do not take place (at any point) within the boundaries of Sylvan Lake. The ticket I received clearly states that the offense took place WITHIN the city of Sylvan Lake. These officers may not realize it but they are not within their jurisdiction and the tickets they are writing may in fact be invalid. For them to write tickets outside of Sylvan Lake, they must first observe an alleged offense taking place within Sylvan Lake. Only then (according to my research of Michigan law) can they follow someone out of Sylvan Lake to apprehend them. I will be using this information to defend myself in only a few weeks. I am hoping to get my ticket dismissed. I will keep everyone posted but wanted to share this information. I am sure that most people simply pay their tickets and assume that everything is valid. In this case, that may very well not be the case!
