Outer Drive and Southfield Freeway/Service Drive

Okay, not truly a speed trap but another example of Allen Park filling their city coffers. "Illegal left turn on red"
According to Michigan Law (MCL 257.612 (1)(i)(ii)) you are allowed to make a left turn on red under the following condition(s):
…a left turn from a 1-way or 2-way street into a 1-way roadway carrying traffic in the direction of the left turn unless prohibited by sign, signal, marking, light, or other traffic control device.
I received a ticket today for making a left turn from Outer Drive onto the northbound Southfield Service Drive. The ticket states this is a local not a State ordinance. There is no signage stating that a left turn on red is not allowed. Be warned! I have done this numerous times and today I got a ticket for doing this. I am fighting this ticket!

Comments:
I am going to try the samething becouse they got me for the samething on1-6-11 about 7:30 pm did you go to court and how did it come out?

I got caught in the same "trap" at Southfield and Outer Drive. I was heading west on Outer Drive and made a "right on red" on to northbound Southfield service drive. There is in fact a "no right on red" sign at the intersection, but it is obscured --- I mean really difficult to see --- while approaching the intersection and while sitting at the light. The AP Police car was sitting on the service drive and immediately pulled me over and issued the ticket. No mercy! I tried to fight it; took photos to prove how obscured and hard to see the sign actually is, to no avail. The "allowed" me to plead to "obstruction of traffic" (no points; no insurance company problems), but the fine cost $140. This is nothing but a cash machine for Allen Park -- a city I now avoid like the plague. They were totally unreasonable and unwilling to admit. They told me I could fignt it if I wanted to take it to trial, but many have tried and all have failed. Don't visit Allen Park --- ever. Bunch of crooks!

I'd like to know how this turned out (the first post) - You said that "According to Michigan Law (MCL 257.612 (1)(i)(ii)) you are allowed to make a left turn on red under the following condition(s): ...a left turn from a 1-way or 2-way street into a 1-way roadway carrying traffic in the direction of the left turn unless prohibited by sign, signal, marking, light, or other traffic control device." You are NOT allowed to turn onto the Southfield from Outer Drive (either north or southbound) on red. There is a dedicated light for turning. Unless that light has the green arrow flashing, you can not legally complete your turn onto the service drive. I make this turn from westbound Outer Drive onto Northbound Southfield every day and get sick of people honking their horn for me to turn while the light is still red. This intersection carries one of those exceptions to the left turn on red rule stated in the law.

Hope you won your case. Notice that you never see AP PD waiting in prey anymore? I received a ticket too, took it to court and proved the officer wrong. The word "LEFT" above the light is for the lane designator, not a prohibition. The turn itself would have been prohibited if the WB and EB lanes had a median divider of 30 feet or more. Would have meant that upon making the turn, a new intersection was crossed, however in this case the median has a maximum width of 21' making it a 2 way roadway instead of 2 separate roads. I told the officer he needed to studying up on his laws. Even in the What every driver must know book (for drivers education and provided for by the SOS) it states that a turn onto a 1 way is permissable unless a prohibition is posted. The word left atop a signal post is not a prohibition. Too many signals out there with the word left or right above them and they only control the lane movement. Those familiar with Madison and I375 in Detroit are aware that Madison is a one way and the service drive is a one way. The signal above the roadway has the word LEFT above it, yet everyone makes the turn on red after stopping. Why? Because there is no prohibition and the the driver is turning onto a one way. Too many people got screwed in Allen Park by having to pay a ticket for making a perfectly legal left turn (assuming they stopped first). The prosecutor offered me a deal too, turned it down, because I knew I was right. I presented proofs that the turn was legal.
